Products sold directly by Feskozy are clearly identified on our website. When you purchase products directly from Feskozy, you enter into a contract with Feskozy, and these Terms apply to your purchase.

Affiliate Products

Some products on our Site are sold through affiliate partnerships with third-party retailers (e.g., eBay, Amazon). These products are clearly marked with retailer badges and affiliate notices. When you purchase through an affiliate link:

  • You will be redirected to the retailer's website to complete your purchase
  • You enter into a contract directly with the retailer, not with Feskozy

  • Feskozy is not a party to the transaction and is not responsible for the product, pricing, shipping, returns, or customer service

4. Orders and Payment

Orders for Feskozy Products

When you place an order for products sold directly by Feskozy, you are making an offer to purchase products at the prices stated. We reserve the right to accept or reject your order for any reason, including but not limited to:

  • Product availability
  • Errors in pricing or product information
  • Suspected fraud or unauthorized transactions

Payment must be received before we ship your order. We accept major credit cards and other payment methods as indicated during checkout. All payments are processed securely through our payment processors.

Affiliate Product Orders

When you click on an affiliate product link, you will be redirected to the retailer's website. All orders, payments, and transactions for affiliate products are handled directly by the retailer. Feskozy does not process payments, handle orders, or have access to your payment information for affiliate product purchases.

5. Shipping and Delivery

Feskozy Products

We will make every effort to ship your order within the timeframe specified. However, shipping times are estimates and not guaranteed. We are not responsible for delays caused by shipping carriers or customs.

Risk of loss and title for products purchased from Feskozy pass to you upon delivery to the carrier.

Affiliate Products

Shipping and delivery for affiliate products are handled entirely by the retailer. Feskozy is not responsible for shipping, delivery times, or any issues related to the shipment of affiliate products. Please refer to the retailer's shipping policy for information about shipping methods, costs, and delivery times.

6. Returns and Refunds

Feskozy Products

Our return and refund policy for products sold directly by Feskozy is detailed in our Return & Refund Policy. Please review this policy before making a purchase.

In summary, we accept returns of unused products in their original packaging within 30 days of delivery. To initiate a return, please contact us at support@feskozy.com. Refunds will be processed to the original payment method within 5-10 business days after we receive and inspect the returned item.

Affiliate Products

Returns and refunds for affiliate products are handled entirely by the retailer, not by Feskozy. You must contact the retailer directly for any return or refund requests. The retailer's return policy, timeframes, and conditions apply. Feskozy is not responsible for processing returns or refunds for affiliate products.

7. User Accounts

When you create an account with us, you must provide information that is accurate, complete, and current. You are responsible for safeguarding the password and for all activities that occur under your account.

You agree not to disclose your password to any third party and to take sole responsibility for any activities or actions under your account.

8. Prohibited Uses

You may not use our Site:

  • In any way that violates any applicable national or international law or regulation

Affiliate Products Disclaimer

Feskozy does not warrant, endorse, or assume responsibility for any affiliate products sold through third-party retailers. We are not responsible for:

  • The quality, safety, or performance of affiliate products
  • The accuracy of product descriptions, images, or pricing provided by retailers
  • Shipping, delivery, or fulfillment of affiliate product orders
  • Returns, refunds, or customer service for affiliate products
  • Any disputes between you and the retailer

All warranties, representations, and guarantees regarding affiliate products are provided by the retailer, not by Feskozy.

11. Limitation of Liability

In no event shall Feskozy or its suppliers be liable for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption) arising out of the use or inability to use the materials on Feskozy's website, even if Feskozy or a Feskozy authorized representative has been notified orally or in writing of the possibility of such damage.

Liability for Affiliate Products

Feskozy shall not be liable for any damages, losses, or injuries arising from your purchase or use of affiliate products. Any claims, disputes, or issues related to affiliate products must be directed to the retailer. Feskozy's liability is limited to the commission we may receive from the retailer, which does not exceed the amount of any commission actually received.

Liability for Feskozy Products

For products sold directly by Feskozy, our liability is limited to the purchase price of the product. In no event shall Feskozy be liable for indirect, incidental, special, consequential, or punitive damages arising from your purchase or use of Feskozy products.

12. Product Liability for Feskozy Branded Products

This section specifically addresses product liability for products sold directly by Feskozy under the Feskozy brand.

Product Safety and Compliance

Feskozy is committed to providing safe, high-quality products. All Feskozy branded products are designed and manufactured to comply with applicable safety standards and regulations. However, you acknowledge and agree that:

  • Products must be used in accordance with their intended purpose and any provided instructions
  • Products should be inspected upon receipt for any visible defects or damage
  • Any product that appears damaged or defective should not be used and should be returned immediately
  • Products should be kept out of reach of children when appropriate

Limitation of Product Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, FESKOZY SHALL NOT BE LIABLE FOR ANY PERSONAL INJURY, PROPERTY DAMAGE, OR OTHER HARM ARISING FROM THE USE, MISUSE, OR INABILITY TO USE FESKOZY BRANDED PRODUCTS, EXCEPT TO THE EXTENT SUCH HARM IS DIRECTLY CAUSED BY A DEFECT IN MATERIALS OR WORKMANSHIP THAT EXISTED AT THE TIME OF PURCHASE AND THAT WAS NOT DISCOVERABLE THROUGH REASONABLE INSPECTION.

Warranty Coverage

Product liability for Feskozy branded products is subject to the terms of our Warranty Policy, which provides a limited one-year warranty against defects in materials and workmanship. This warranty is your exclusive remedy for defective products, subject to the limitations set forth in the warranty policy.

Indemnification

You agree to indemnify, defend, and hold harmless Feskozy, its officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of or relating to your misuse of Feskozy products, failure to follow product instructions, or use of products in a manner for which they were not designed.

State Law Rights

Some states do not allow the exclusion or limitation of incidental or consequential damages, or the limitation of liability for personal injury, so the above limitations may not apply to you. This warranty gives you specific legal rights, and you may also have other rights which vary from state to state.

13. Governing Law

These Terms shall be interpreted and governed by the laws of the United States, without regard to its conflict of law provisions.

14. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days notice prior to any new terms taking effect.
